ACTIVITY RELEASE OF LIABILITY
READ CAREFULLY - THIS AFFECTS YOUR LEGAL
RIGHTS
In exchange for
participation in the activity of Hands-on participation in backflow prevention assembly
testing organized by Water Industry Training Specialists, Inc.
("WITS"), of 1131 Elko Drive, Sunnyvale, California, 94089 and/or use
of the property, facilities and services of WITS, I agree for myself to the
following:
1. I agree to
observe and obey all posted rules and warnings, and further agree to follow any
oral instructions or directions given by WITS, or the employees,
representatives or agents of WITS.
2. I recognize
that there are certain inherent risks associated with the above described
activity and I assume full responsibility for personal injury to myself and (if
applicable) my family members, and further release and discharge WITS for
injury, loss or damage arising out of my or my family's use of or presence upon
the facilities of WITS, whether caused by the fault of myself, my family, WITS
or other third parties.
3. I agree to
indemnify and defend WITS against all claims, causes of action, damages,
judgments, costs or expenses, including attorney fees and other litigation
costs, which may in any way arise from my or my family's use of or presence
upon the facilities of WITS.
4. I agree to pay
for all damages to the facilities of WITS caused by my or my family's
negligent, reckless, or willful actions.
5. Any legal or
equitable claim that may arise from participation in the above shall be
resolved under California law.
STUDENT CODE OF ETHICS POLICY
Students are expected to adhere to and
practice the following Code of Ethics:
I. Representation
Every student is expected to represent him or herself honestly and respectfully
in all situations, whether orally or in written statements.
II. Academic Honesty
Students are expected to maintain the highest standards of academic integrity.
Academic dishonesty includes lying, cheating, stealing, and using unauthorized
materials on any assignment, quiz or exam.
III. Illegal Substances: The use of illegal drugs and alcohol is not permitted
on WITS, Inc. property as well as the abuse or misuse of prescription drugs.
IV. Sexual Assault and Harassment: Students shall refrain from using language
or acting in a manner that is disrespectful or inappropriate towards other
students and the staff of WITS, Inc.
IV. Respect for the Open Exchange of
Ideas
Students shall be guaranteed that their First Amendment right of Freedom of
Speech will be observed by all WITS, Inc. members, including other students.
V. Classroom Conduct: Students must behave respectfully toward their peers and
instructors.
PRIVACY POLICY AND INFORMATION OF LEARNER RECORDS
Policy:
Water Industry Training Specialists, Inc. recognizes the importance of
student record security (particularly in an environment where digital records
increasingly form the bulk of student records) and therefore diligently
protects the security, confidentiality, and integrity of student records by
employing strict security measures to protect and back up data.
Responsibilities:
Human Resources and the CEU
Administrator are responsible for all personnel records for students. No one other than the CEU Administrator and
Human Resources may give out record information without receiving a written
request for records to be released. All
inquiries for transcript requests, referrals are directed to the Human Resource
Director and CEU Administrator.
Procedures:
All (electronic files), including
student records, are saved on a network server to ensure backup of the data.
The system, which contains all student information, is backed up nightly;
additional full backups of WITS and BPS computer systems occur weekly. Users of
information systems are prohibited from accessing data or programs for which
they are not authorized. WITS personnel follow these guidelines and must sign
statements agreeing to this. All employees undergo a criminal background check
to ensure "safety and the security of personal and Company property." These
background checks take place upon initial hiring. Anyone who is terminated and has access to
information is taken out of the system on the evening before the employee's
status changes.
Human
Resources
Confidential discipline records are
maintained in the Human Resource Office. All paper records are kept in locked file cabinets. Only authorized
personnel are issued keys to those files. Electronic logs are kept in a secure
folder on a secure drive that has permissions set such that only authorized
personnel may access the data.
I have read and
understand the WITS, Inc. Activity Release of Liability Policy. I further
understand that by signing this release I voluntarily surrender certain legal
rights. I have read and understand the WITS,
Inc. Ethics Policy and agree to abide by its terms and conditions. I have read and understand the WITS, Inc.
Privacy Policy and Information of Learner Records policy.
